Lawfare - Hard National Security Choices: There was Never a National Security Need for the Travel Ban

Today, there is much pondering about the strength or weakness of the courts’ latest rulings on Trump's revised immigration Executive Order and prognosticating about what may happen on appeal or when the issue finally reaches the Supreme Court. There are also complaints from those in Trump’s camp that the courts are unduly tying the Executive’s hands from protecting this country from visa and refugee applicants that pose a potential national security risk. Beyond analyzing whether the court rulings are right and will be sustained, it is helpful to take a step back and recognize that there was never a need for a travel ban or refugee ban in the first place—even if the President was quite sincerely concerned about granting visa and refugee status because of apprehensions about the reliability and quality of information emanating from the six named countries.
The ban is flashy and is being used to satisfy campaign promises, but the concerns specified in the EO could have been addressed with no controversy and little fanfare. The President could have simply instructed the Secretaries of State and DHS that everyone receiving a visa or refugee status must meet the same rigorous national security standards. He could have made clear that if the relevant national security information (including the alien’s identity and history) regarding any alien seeking entry from any country is unreliable, the consular officer must deny the visa/refugee status. The President could further have instructed the Secretaries that, if the chaos in a country prevents an applicant from presenting reliable records, then the visa application or refugee status should be denied by the consular officer (or at least delayed until more reliable information can be provided).
If, as the President and his aides state, the chaos in the specified six countries prevents reliable decisions, then consular officers, properly instructed, will more often deny visas; and if the information is always unreliable, then visas will be regularly denied. But this could have been done on a case-by-case basis, looking at the actual records of the applicant under uniform standards—and without any religious or nationality discrimination. Under this regime, there would be no Muslim or six-country ban, but all of the EO’s stated objectives would be met, without any potential court challenge.
If the President had been properly advised, that would be the state of affairs today, as opposed to an unprecedented ban that threatens to undermine the broad judicial deference that has applied to the Executive in the immigration context for more than 100 years.  
So my advice is that instead of racing to the Supreme Court to obtain a ruling (which is certain to create a very bad precedent one way or the other), the President should go back to the drawing board one more time and do this the right way.

Washington Free Beacon: Maxine Waters Creates Graphic to Show Trump’s ‘Kremlin Klan’

Rep. Maxine Waters (D., Calif.) has previously accused President Donald Trump of being part of a "Kremlin Klan" beholden to Russian interests, but she took the charge a step further on Thursday, disseminating a graphic she created of Trump associates who she has deemed part of this group.
The graphic, with Moscow in the background and an image of Russian President Vladimir Putin looming overhead, pictures several senior Trump administration officials and other associates of the American president labeled with their names.
Waters tweeted out the image from her official account, with the note "Prepared by Rep. Maxine Waters" in the bottom right corner of the graphic.


Trump is in the middle of the graphic, underneath an image of Putin, surrounded by headshots of WikiLeaks founder Julian Assange, Secretary of Commerce Wilbur Ross, Trump's son-in-law Jared Kushner, former National Security Adviser Michael Flynn, and 12 other men connected to the president. The words "Trump's Kremlin Klan" are written at the top of the graphic.
Waters has pushed her "Kremlin Klan" label since the beginning of the Trump administration, accusing the president's associates of conspiring with Russia to get money from the oil and gas industry.
"He [White House chief of staff Reince Priebus] can't continue to try to defend this president, who is entangled with this Kremlin clan of his, while they are all seeking really to get rid of these sanctions that are placed on Russia because all of them are connected to the oil and gas industry," Waters said last month.
During the same interview, she called Trump's associates "a bunch of scumbags."
"It's clear to me, and I just think the American people had better understand what's going on," Waters said. "This is a bunch of scumbags. That's what they are."
Waters has been one of the president's most vocal opponents in Congress since he entered the White House, repeatedly calling for Trump's impeachment. The California Democrat said last month that her greatest desire is to lead Trump to impeachment.
Many congressional Democrats have not been as willing to criticize Trump and call for his impeachment, leading Waters to call her Democratic colleagues too "nice."
Waters has vowed to fight Trump "every inch of the way" during his presidency.

Manhunt ends with arrest after 2 Detroit officers shot on west side

Police late Wednesday arrested a man suspected of shooting two Detroit police officers earlier in the evening, ending a massive manhunt that covered several blocks of the city's west side.
One officer was shot in the ankle and the other in the neck; they reportedly drove themselves to Detroit Receiving Hospital and both were expected to survive.
When officers caught up to the suspect in the vicinity of the manhunt he was found with gunshot injuries to his leg. Police believe those injuries came during his original exchange of gunfire with the two officers.
A handgun was recovered and he was taken to a hospital.
At Receiving Hospital earlier, officers milled around awaiting word on the injured officers.
Chief James Craig said the two officers were on special operations in a semi-marked police car, wearing body armor, doing a narcotics investigation not far from where Wayne State University Police Sgt. Collin Rose was fatally shot Nov. 22.

They were questioning a person when the suspect started making furtive movements, then pulled out a gun and fired several shots. The two officers returned fire, apparently hitting him in the leg.
Craig said one of the officers, a 20-year veteran of the department, had a through-and-through wound to the neck. Doctors were optimistic the officer would survive.
The other officer, a 40-year veteran, was shot in the ankle, with injuries not as serious. Two bullets to his upper torso were stopped by his body armor, Craig said.
Craig asked that metro Detroiters keep both officers in their prayers.
"We're not prepared to say there's a connection between this suspect and the Collin Rose case but we're investigating to look for a link," said Craig. Police said the gun recovered late Wednesday will be tested for any evidence it's connected to the Collin Rose shooting.
Mayor Mike Duggan was also on the scene.
Earlier in the evening, police from several departments swarmed the neighborhood near 23rd and Ash in a search for the gunman.
Officers with long guns drawn and wearing heavy gear searched, shining flashlights into the burned-out rubble of homes. Several blocks were closed off and a police dog was on the scene.
