А.Атамбаев: Добрый день, уважаемые участники сегодняшней пресс-конференции!
Только что завершились кыргызско-российские переговоры в рамках официального визита в Кыргызскую Республику Президента Российской Федерации.
Отмечу, что это знаковое событие, потому что этот визит проходит в канун 25-летия установления дипломатических отношений. Эта дата будет отмечаться 20 марта.
И сегодня мы и в узком кругу, и в широком кругу обсудили практически весь спектр вопросов двустороннего сотрудничества. Я не буду детально на вопросах останавливаться, скажу только, что мы, я бы сказал, практически по всем вопросам пришли к полному взаимопониманию, и при этом мы обсуждали и экономику, и вопросы безопасности, и военно-техническое сотрудничество, и, конечно же, интеграционные процессы в Евразийском экономическом союзе.
Мы обменялись мнениями и по другим вопросам, в том числе международным. И здесь я хочу сказать, что в международных вопросах наши страны занимают в основном или совпадающие, или очень близкие позиции.
Естественно, мы рассмотрели и ход реализации достигнутых договорённостей, потому что у нас скоро, в начале марта, ожидается приезд Председателя Правительства России. И мы здесь наметили тоже, чтобы председателям правительств, всем руководителям кабинетов министров ЕАЭС было легче двигаться дальше.
Я скажу так, что я и вся киргизская делегация довольны результатами переговоров, и мы благодарны за это российской делегации и, конечно же, уважаемому Владимиру Владимировичу Путину. По итогам переговоров принято Совместное заявление, но и будут, я надеюсь, у нас в будущем, во время моего визита в Россию, подписан и ряд других очень хороших вещей.
В заключение, уважаемый Владимир Владимирович, хочу ещё раз поблагодарить Вас за визит, за Вашу поддержку нашей страны и предоставить Вам слово.
В.Путин: Спасибо большое.
Уважаемый Алмазбек Шаршенович! Дамы и господа, друзья.
Переговоры с Президентом Киргизии по традиции прошли в деловой и конструктивной обстановке. Мы детально обсудили весь комплекс взаимодействия и сотрудничества, наметили конкретные планы по развитию нашего взаимодействия на будущее.
Хочу сразу же отметить и подчеркнуть: Киргизия является стратегическим партнером России. Нас объединяют проверенные временем дружественные и подлинно союзнические связи. В марте этого года, как Президент уже сказал, мы отмечаем 25-летие установления дипломатических отношений.
Наши страны стремятся к углублению многопланового и взаимовыгодного сотрудничества. Мы настроены совместно преодолевать трудности текущего дня, спад в торговле, разработать конкретный набор мер для решения этой задачи. Условились более полно использовать преимущества, которые дает членство Киргизии в Евразийском экономическом союзе. Кстати, Киргизия в этом году председательствует в ЕАЭС, а в ближайшее время в Бишкеке должно пройти заседание Высшего Евразийского экономического совета.
Отмена таможенных, санитарных и фитосанитарных барьеров должна способствовать, да и уже способствует формированию тесных интеграционных связей, как в торговле, так и в промышленности, в сельском хозяйстве. Хотел бы в этой связи отметить, что эффективно используя эти преимущества, в том числе используя эти преимущества, Киргизия добилась в ушедшем году очень хороших результатов. На фоне всех экономических сложностей рост ВВП – более трех процентов, и рост промышленного производства – более четырех процентов.
Россия активно помогает Киргизии в процессе адаптации к требованиям Евразийского экономического союза. Киргизской стороне предоставлена помощь на сумму 200 миллионов долларов, в том числе для модернизации объектов таможенной инфраструктуры и обустройства пограничных пунктов.
Действует двусторонний Фонд развития. Мы только что с Алмазбеком Шаршеновичем обменивались впечатлениями о том, как работает этот фонд. Это, в принципе, уникальный инструмент, он создан в 2014 году, с капиталом в размере 500 миллионов долларов. В настоящее время с финансовым участием Фонда в Киргизии уже реализуются проекты на сумму свыше 200 миллионов долларов.
Россия оказывает Киргизии содействие в целях стабилизации бюджета. Общая сумма соответствующих грантов составила к сегодняшнему дню 225 миллионов долларов.
Проводим постепенное списание государственного долга Киргизии. Это уменьшает нагрузку на финансовую систему страны, расчищает баланс, освобождает средства на важнейшие, в том числе социальные программы развития республики.
Поддержка киргизским партнерам предоставляется и за счет беспошлинного экспорта из России нефтепродуктов. В 2016 году в Киргизию по этим схемам поставлено свыше миллиона тонн нефтепродуктов.
Российская компания «Газпром» ведет масштабную работу по реализации генерального плана газоснабжения и газификации Киргизии до 2030 года. Совокупный объем инвестиций в республиканскую газотранспортную распределительную сеть составит 100 миллиардов рублей. В результате уровень газификации Киргизии [возрастет] с нынешних 22 процентов и будет составлять 60 процентов.
Значительный вклад в экономическое развитие Киргизии вносят денежные переводы киргизских граждан, работающих в России. После вступления Киргизии в ЕАЭС объемы таких трансфертов выросли на 18,5 процента. За январь-сентябрь 2016 года они составили 1,3 миллиарда долларов США, это почти 30 процентов ВВП страны. Но это только то, что мы знаем по банковским и почтовым переводам. На самом деле, конечно, больше. Киргизские граждане имеют теперь одинаковые с гражданами других государств – членов Союза права при устройстве на работу в России.
Особое значение для нашего сотрудничества имеют контакты между людьми, культурные, научные, образовательные обмены. В 2016 году в Киргизии с успехом прошли Дни культуры России, Неделя российского кино. Киргизская сторона выразила готовность провести в этом году в России ответные Дни культуры Киргизии.
В российских вузах учатся свыше 16 000 киргизских граждан, в том числе 5 000 – за счет российского бюджета. В текущем году у нас на безвозмездной основе начали обучение еще 420 киргизских студентов.
В свою очередь в Киргизии большое внимание уделяется изучению русского языка, за что мы особо благодарны Президенту Киргизии и всем нашим киргизским партнерам и друзьям. Растет число школ с преподаванием на русском языке. Это 200 школ с обучением на русском языке, 414 – на русском и киргизском языках. В сентябре 2016 года в Бишкеке при поддержке Российского фонда мира и при поддержке, конечно, наших киргизских друзей, прежде всего Президента, открыта новая школа имени Антона Павловича Чехова.
В ходе переговоров констатировали совпадение позиций наших стран по многим актуальным вопросам региональной и глобальной повестки дня. При этом мы уделили особое внимание теме совместного противодействия вызовам и угрозам сегодняшнего дня в Центральной Азии, борьбе с терроризмом, наркотрафиком, трансграничной оргпреступностью.
В этом контексте договорились активнее укреплять двустороннее военное и военно-техническое сотрудничество. Подтвердили общее понимание, что присутствие российской военной базы в Киргизии является важным фактором, обеспечивающим стабильность и безопасность в центрально-азиатском регионе.
В заключение хотел бы еще раз выразить признательность киргизскому руководству и Президенту Алмазбеку Шаршеновичу Атамбаеву за радушный прием и обстоятельные переговоры, которые сегодня состоялись. Уверен, что этот визит, безусловно, послужит дальнейшему поступательному развитию российско-киргизских отношений на благо народов Киргизии и России.

Вопрос: Хотелось бы получить ответ на вопрос от двух президентов. Вопрос о сотрудничестве в сфере безопасности: поднимался ли вопрос о расширении российского военного присутствия на авиабазе Кант?
И, наконец, получила ли российская сторона заверения, что транзит власти в Кыргызстане осенью этого года пройдёт без потрясений? Спасибо.
А.Атамбаев: Вопрос о расширении российской базы мы даже не рассматривали. Мы рассматривали вопрос об укреплении киргизской армии, вооружённых сил Кыргызстана и об активизации поставок вооружения, оборудования, то есть совсем другая ситуация. Россия хочет помочь нам укрепить собственные наши вооружённые силы.
По транзиту власти Владимир Владимирович у меня даже и не спрашивал. Я хотел бы уже от себя сказать, что, если кто-то надеется сделать революцию в Кыргызстане, хочу напомнить, что лидером обоих прошедших революций, сегодня могу сказать, был Атамбаев. И в 2005 году колонна, которая взяла Белый дом, пришлась на долю Атамбаева, и в 2010 году, если вы сейчас вспомните, где собирались возмущённые граждане Кыргызстана, – возле офиса Атамбаева. Поэтому, если будет третья революция, я не буду её делать.
Я вам так скажу, на революции в Кыргызстане поставлена точка, потому что нам нельзя, как раньше в песне пели (и меня Владимир Владимирович подкалывал): «Есть у революции начало, нет у революции конца», – уже надо работать. Кыргызстан отныне должен быть нормальной развивающейся страной. И последние показатели говорят о том, что мы правильно идём. Тем, кто хочет власти, не надо революций и лезть на Белый дом через забор – пожалуйста, участвуйте в выборах и в парламентских, и в президентских.
Поэтому такие вопросы мы не обсуждали с Владимиром Владимировичем, мы обсуждали вопросы экономики и развития двусторонних отношений.
В.Путин: Что касается военного присутствия России в Кыргызстане – я напомню, а может быть, и проинформирую тех, кто этого не знает, как возникла наша база в Канте. Она возникла по просьбе кыргызстанского руководства в 1999–2000 годах, тогда, когда Киргизия столкнулась с атакой международных террористов, которые перешли границу из Афганистана. И тогда меня, вот меня лично действующее руководство Киргизии попросило срочно разместить военный контингент, прежде всего авиацию, для того, чтобы была возможность эффективно бороться с террористической угрозой. Как вы помните, там были и трагические события, люди погибли, и авиация соседних стран там работала. Но тогдашнее киргизское руководство пришло к выводу, что если это будет постоянно действующий контингент, который знает обстановку в республике, проводит соответствующие учения, и если уж возникнет необходимость применения вооружённых сил, авиации, чтобы действовали высокопрофессионально, точно и по согласованию с киргизской стороной. Вот откуда возникла база.
Если когда-то Кыргызстан скажет, что мы настолько укрепили свои вооружённые силы, что такая база не нужна, мы в этот же день уйдём. Нам нет никакой необходимости здесь размещать воинский контингент. Он связан только с одним – с обеспечением безопасности самой Киргизии. Ну а после того, как мы начали расширять свои отношения в рамках ОДКБ, то это само собой разумеется, сейчас Президент об этом сказал, мы будем заниматься тем, чтобы и дальше укреплять вооружённые силы самого Кыргызстана. Мы сегодня об этом говорили – собственно, не в первый раз. В рамках экспертной работы на уровне ОДКБ будем спокойно, ритмично этим заниматься.
Вопрос о расширении воинского контингента мы не обсуждали пока. Если Кыргызстан сочтёт необходимым это сделать, то тогда и обсудим, но имейте в виду, что для нас это тоже дополнительные расходы. Но будем в рамках ОДКБ и на двусторонней основе это обсуждать, если такая потребность есть.
Теперь что касается внутриполитических процессов. Это не наше дело, мы никогда не вмешиваемся во внутриполитические процессы других стран, тем более наших союзников. Но я полностью присоединяюсь к тому, что было сказано Президентом Атамбаевым. Мы исходим из того, что на всём постсоветском пространстве мы должны ценить стабильность, и исходим из того, что любая смена власти должна происходить в рамках конституции и действующего закона.
Вопрос: Владимир Владимирович, тема ЕАЭС является одной из ключевых в ходе Вашей поездки. Какие Вы видите позитивные моменты сейчас в этом интеграционном объединении? Обсуждались ли перспективы развития ЕАЭС, может быть, какие-то сложности, в том числе, например, в свете последних действий белорусского руководства?
В.Путин: Я скажу последовательно по мере того, какие вопросы Вы формулировали. Я считаю, что интеграционные процессы на постсоветском пространстве – абсолютно естественное дело и чрезвычайно полезное для всех. Мы много раз это обсуждали и говорили. Нам от прежних поколений досталось много из того, что представляет абсолютную ценность и чем мы в прежние десятилетия не очень дорожили.
Но возьмем пример европейской интеграции. Там для того, чтобы им между собой разговаривать, 28 переводчиков работают. У нас есть русский язык, который является языком межгосударственного общения. Это на самом деле не только технический вопрос. Это вопросы, в которых заложена в значительной степени и экономическая субстанция, как это ни покажется странным. Затем у нас есть общая инфраструктура (транспортная, дорожная сеть, железная дорога, энергетическая инфраструктура), у нас очень высокая степень кооперации, доставшаяся нам еще с советских времен. Не дорожить всем этим, не придавать этому новое качество и не использовать было бы глупо на фоне того, что в мире происходит. А в мире везде происходят региональные интеграционные процессы, очень активно развиваются.
Что мы видим в качестве результата? Смотрите, мы фактически открыли свой рынок для товаров наших партнеров. Но мы заинтересованы в этих товарах. Только что с вами – я думаю, этот пул [журналистов] тоже там был – мы были в Таджикистане. Но мы заинтересованы в товарах, поступающих из Таджикистана. Это, прежде всего, плодоовощная продукция. Так же как заинтересованы и в товарах из Кыргызстана. И это дешевле, это даже качественнее, чем мы получали раньше из многих стран, в отношении которых ввели определенные ограничения на поставку на наш рынок. Рост экономик всех этих стран очевиден. На фоне очень скромной позитивной динамики российской экономики в Кыргызстане уже 3,8 процента рост ВВП и 4,1 процента – рост промышленного производства. Очевидные преимущества. Такие же преимущества и для нас. Поэтому я считаю, что это абсолютно естественный процесс. Было бы глупо всем этим не воспользоваться.
Что касается споров, то эти споры тоже вполне естественны. Каждая сторона отстаивает свои интересы. Я сейчас приводил цифры поддержки со стороны России мягкой адаптации киргизской экономики к требованиям Евразийского экономического союза. Но у нас и с белорусскими нашими друзьями тоже споры идут, и поиски решений этих спорных вопросов. Должен сказать, что Белоруссии мы, конечно, оказываем помощь несопоставимо большую, чем Кыргызстану. Если я сказал, что мы с обустройством границы Кыргызстану помогли, там 225 миллионов, 200 миллионов долларов дали в виде грантовой поддержки, 500 миллионов – это фонд для развития, из которых 200 с лишним миллионов уже в работе, это почти 1 миллиард долларов, – то одних кредитов, выданных на Белоруссию, свыше 6 миллиардов долларов.
Рынок наш полностью открыт для белорусских товаров. Беспошлинные поставки нефти на белорусские предприятия идут. А перерабатываемые нефтепродукты поставляются Белоруссией за границу с взиманием пошлины и зачислением этой пошлины в белорусский бюджет.
Если вы посмотрите цифры, которые представляет МВФ, то вы увидите впечатляющие цифры скрытой и прямой поддержки белорусской экономики. Но мы об этом не жалеем, потому что, что называется, в «долгую» и российская экономика получает и получит выгоду от совместной работы, потому что это усиливает наш синергетический эффект и повышает нашу общую конкурентоспособность. Поэтому это для нас не выброшенные деньги, это просчитанные шаги в расчете на будущий результат.
А споры всегда есть. Я уверен, что мы найдем выход из любых, даже, казалось бы, очень трудных ситуаций.
Вопрос: Первый вопрос я адресую Алмазбеку Шаршеновичу. Есть силы, которые пытаются представить уголовное дело в отношении Омурбека Чиркешовича [Текебаева], как политически мотивированное. Что Вы могли бы на это ответить и действительно ли можно считать это политическим преследованием Текебаева. Об этом расскажите, пожалуйста.
А.Атамбаев: Вы знаете, я об этом говорил, по-моему, первый раз еще в 2010 году, что в то время, как погибли люди на Майдане (на нашем, бишкековском), в то время, как на юге страны в этнических столкновениях погибли люди, кто-то здесь распиливал миллионы. Я об этом в 2010 году говорил. И после этого я неоднократно говорил, что все это однажды выплывет наружу. И вы знаете, я смотрел вчера вечером российский сайт, куда дал интервью этот гражданин России, который осмелился дать показания уже. У него спросили: «Почему Вы так долго не обращались тогда?» Он просто сказал: «Я боялся и не верил, что Президент возьмется за это дело».
Я не буду скрывать, все думали, что и Атамбаев, как многие другие, есть в доле, что он в доле, а то, что в Кыргызстане, в Бишкеке, к сожалению, после революции 2010 года было мародерство, был рэкет, всякая грязь была, это же правда, это мы все знаем. Это правда, и горькая правда то, что кто-то погибал, простые люди, а те, кто через их смерть, на их крови пришел к власти, потом стали зарабатывать деньги. А то, что сейчас не только Текебаев, а уже многие деятели, скажем так, которые пришли к власти в 2010 году и руководили силовыми ведомствами, были руководителями временного правительства, об этом кричат, я думаю, они просто боятся, что их темные дела тоже выплывут.
Я еще раз скажу, что вор должен сидеть в тюрьме, кто бы это ни был. Кто бы это ни был. И если ты стал в 2010 году членом временного правительства или кем-то из руководителей, это не должно быть индульгенцией. В этом беда всех революций, что простые люди погибают, а кто-то потом на этом наживается, делает большие деньги. Поэтому я здесь никакой политики не вижу, я вижу политику в том, что многие другие стали бояться, что их дела выплывут наружу, я бы сказал так открыто. И тогда они тоже скажут: «Вот это тоже репрессия», – и так далее. Слушайте, какая это репрессия? Это чистой воды мошенничество и коррупция, потому что ладно, если бы только два гражданина России заявили. Во-первых, их будет больше, потому что много свидетелей было. И во-вторых, об этом случае уже последние три года, по-моему, все время твердит экс-депутат от этой же партии, «Ата-Мекен», Абдурахманов Омурбек. Все это будет выплывать. Я не знаю, у следующего Президента хватит духу это доводить? Но при мне это будет доводиться до конца. И потом, когда я уже не буду Президентом, я все-таки останусь в политике.
И поверьте мне, вчера, когда у меня были родители погибших ребят, дети приходили, они требовали только одного, чтобы те, что на крови зарабатывал деньги вместо того, чтобы честно работать, должны заплатить в полной мере. И я считаю это справедливым. Это урок будет на будущее, что не надо больше. Есть такая русская поговорка: «Для кого война, а для кого – мать родна». И поэтому еще раз говорю, нам надо дать навсегда урок всем этим мародерам, тем, кто их покрывал, рейдерам, коррупционерам, чтобы неповадно было, потому что многие поднимались из-за того, что жить было тяжело.
А в 2005 году и в 2010 году – мы видим, что история повторяется в том плане, что кто-то из этого фактически делал деньги. Так я скажу. И поверьте мне, я не удивлюсь, если завтра эти показания польются как поток, потому что все думали, что Атамбаев в доле. Атамбаев никогда не воровал. Он заработал. Когда Атамбаев уже стал миллионером, многие сегодняшние миллионеры только начинали бизнес: Саламбеков только начинал, Бабанов учился в сельхозакадемии в Москве, а я уже был здесь долларовый мультимиллионер. Я хочу об этом еще раз напомнить. Может быть, я чересчур эмоционально, но надо уже работать, прекращать все эти революции, потому что мы видим, что просто гибнут простые граждане.
Хочу сказать, что страна другая, другие силовые структуры, другая власть, другой Президент, которому доверяет народ, и больше бардака в стране не потерпим. Все такие попытки силового давления будут жестко пресекаться. Кто хочет власти – пожалуйста, 19 ноября – выборы нового Президента Кыргызстана.
Вопрос: Владимир Владимирович, Вы сейчас достаточно подробно остановились на итогах Вашей поездки в Бишкек, но за последние дни Вы посетили сразу три среднеазиатских республики. Как бы Вы охарактеризовали отношения, которые сегодня складываются с этими республиками, и какие перспективные направления сотрудничества с этими государствами Вы видите?
И, если позволите, один вопрос немного не по повестке, он касается сирийского урегулирования. Владимир Владимирович, как вы оцениваете нынешний этап сирийского урегулирования? Не мешают ли этому процессу такие действия, как санкции со стороны Совбеза ООН в отношении Сирии, и как бы Вы охарактеризовали роль других государств в урегулировании сирийского конфликта? Спасибо, извините за долгий вопрос.
В.Путин: Что касается тех стран, где мне удалось побывать – Казахстан, Таджикистан и Кыргызстан, – это наши стратегические партнеры, стратегические союзники. Во всех этих странах Россия занимает первое место по уровню торгового оборота, и несмотря на все сложности текущего дня, экономического характера, эта позиция за Россией остается. Я уже говорил о том, насколько эффективно функционируют наши структуры в сфере Евразийского экономического союза. И лучшее подтверждение тому – рост экономики и промышленного производства в этих странах. Это объективные данные, объективные цифры, они сами говорят за себя.
Что является еще существенным для нас в сотрудничестве? Допустим, Таджикистан не является членом Евразийского союза, но на двусторонней основе у нас очень добрые отношения, и позитивно развивается экономика. Есть вещи, которые мы должны регулировать в двустороннем порядке. Например, создание логистических центров в Таджикистане, о чем мы договорились сейчас, будучи в этой Республике, для поставок ускоренной и максимально дешевой продукции на наш рынок, особенно в преддверии наступающего сезона. Мы договорились о создании там логистических центров и о продолжении практики льготирования железнодорожного тарифа. В общем, мы по всем направлениям достаточно активно работаем.
Но не менее важной составляющей является и обеспечение безопасности, борьбы с преступностью и терроризмом, особенно это важно в этом регионе с учетом того, что в соседнем Афганистане проходят очень сложные, если не сказать, тяжелые процессы, вызывающие у нас общую тревогу. Но все эти государства являются членами Организации коллективной безопасности (ОДКБ). Мы и на этой площадке будем дальше согласовывать наши совместные действия и предпринимать необходимые усилия, но и в ходе этого визита мы говорили об этом очень подробно и обстоятельно.
Теперь что касается Сирии. Нас не может не радовать, что очень позитивно прошел и закончился процесс в Астане, безусловным результатом которого является закрепление режима прекращения огня и создание механизма по контролю за прекращением огня. Без этого невозможно было бы продолжить и Женевские переговоры. Там все идет не так гладко, как хотелось бы, но Астана, эта площадка всегда у нас есть, что называется, в запасе. Мы очень благодарны руководству Казахстана за то, что Президент включился и лично принимал участие даже в ходе этого переговорного процесса.
Что касается санкций, то я думаю, что сейчас это совершенно неуместно в отношении сирийского руководства, потому что это не помогло бы переговорному процессу, а только мешало бы или подрывало бы доверие в ходе этого переговорного процесса. Россия никаких новых санкций в отношении Сирии поддерживать не будет.

Voice of America: Pakistan Hosts Regional Summit Under Tight Security

Pakistan has put in place extremely tight security measures in and around its capital, Islamabad, ahead of Wednesday’s regional economic cooperation summit, where presidents of Iran and Turkey will also be in attendance. The high-profile meeting of the 10-nation Economic Cooperation Organization, or ECO, has been convened at a time when Pakistan is experiencing a new wave of deadly suicide bombings and militant attacks. The anti-state Pakistani Taliban and local affiliates of Islamic State have taken credit for the violence that has claimed scores of lives over the past two weeks. Foreign ministers and senior representatives from ECO countries, including Afghanistan, Uzbekistan, Tajikistan Turkmenistan, Kyrgyzstan, Kazakhstan and Azerbaijan, are already in Islamabad and held preparatory talks Tuesday. Facing challenges Addressing the meeting, Pakistani foreign policy advisor, Sartaj Aziz, underscored the need for member states to collectively work for promoting effective regional economic cooperation to contribute to global peace, stability and prosperity. “Our region is faced with a number of challenges including extremism, terrorism, drug-trafficking and trans-national organized crimes…Therefore, innovative approaches and concerted efforts would be required for the socio-economic and human development of our peoples,” Aziz explained. United Nations and Chinese delegations have also arrived to attend the summit as observers. Iran, Pakistan and Turkey are the founding members of ECO. Tensions Pakistan had to cancel several regional cooperation meetings in recent months because Afghanistan and India boycotted those events. Both the neighboring countries blame Islamabad for supporting terrorist attacks on their respective territories. Pakistani authorities reject the charges as baseless and instead accuse Afghan and Indian intelligence agencies of jointly sponsoring recent militant attacks in the country. Advisor Aziz while addressing Tuesday's meeting recounted Pakistan's successes against terrorism and extremism, saying they have helped improve national security and economy, and created conditions for international investment in the country. “We are therefore confident of providing safe transit passage for smooth flow of trade activities without any barriers.” Despite tensions in bilateral ties, the Afghan government agreed to attend the ECO meeting and is being represented by its ambassador to Islamabad, Hazrat Omer Zakhilwal, who also carries the title of special presidential envoy to Pakistan.

Just Security: Why You Should Doubt Reports that the First Amendment Would Protect Gen. Flynn from Prosecution under the Logan Act

The Logan Act, a 1799 federal law that makes it a federal felony for a private person to engage in international diplomacy in a way that undermines U.S. foreign policy, has recently been plucked from the dustbin of history. As widely reported, Michael Flynn, President Trump’s national security adviser, resigned amid controversy over his phone calls with the Russian ambassador to the United States. It has been reported that the two discussed U.S. sanctions imposed on Russia for its alleged interference in the 2016 presidential election. Flynn allegedly told the Russian ambassador not to worry about the sanctions, since there would soon be a new sheriff in town. The conversations appear to fall within the letter of the Logan Act, which applies to anyone who “directly or indirectly . . . carries on any correspondence or intercourse with any foreign government . . . with intent to influence [it] . . . in relation to any disputes or controversies with the U.S. or to defeat the measures of the U.S.” The Logan Act has been described as a “paper tiger.” No one has ever been successfully prosecuted under the Act, in part owing to doubts about its constitutionality. Specifically, many claim that prosecuting Flynn under the Logan Act would violate the First Amendment. As it turns out, it’s not so clear under the Supreme Court’s case law that communications to a foreign government or agent are fully protected under that constitutional provision – although I will argue that they certainly should be.
By the standards applicable in 1799, the Logan Act almost surely would not have violated the First Amendment. Back then, the concept of freedom of speech was not nearly as robust as it is today. Indeed, some prominent judges and commentators interpreted the First Amendment to prohibit only prior restraints on speech – meaning that governments were free to punish speech after the fact. To give you a sense of just how anemic speech rights once were, federal courts upheld the Sedition Act of 1798, enacted by the same Congress that passed the Logan Act, which criminalized speech critical of the U.S. government and public officials. (President Jefferson later pardoned those convicted during his administration.)
Of course, this is 2017, not 1799. The Supreme Court has not generally interpreted the First Amendment with reference to its eighteenth century meaning – for many reasons, but in part because what it actually meant to those who ratified it is not very clear. Today, the First Amendment is understood to provide robust free speech protections. Some of the strongest protections apply to speech critical of government and communications that address matters of public concern – like Flynn’s phone calls. Under modern free speech rules, laws that target speech based on its content – in the case of the Logan Act, communications about international diplomacy – are subject to a rigorous form of judicial review called “strict scrutiny.” That standard requires the government to have a compelling interest in restricting speech and adopt the least restrictive means of serving its interest. The standard has been described as “strict in theory, but fatal in fact.” And so it has been, in nearly all cases involving content-based laws.
So Flynn would seem to have a slam dunk First Amendment defense. In the abstract, the government may have a compelling interest in ensuring that private citizens do not actually interfere with international diplomacy. But a law criminalizing a broad range of communications with foreign governments and their agents is not narrowly tailored to preventing actual interference with diplomacy. By its terms, the Logan Act seems to prohibit a U.S. citizen from sending a letter or email to Mexican officials encouraging them to reject new trade terms offered by the Trump administration. That hardly seems like a tailored way to address private meddling with international diplomacy.
Before Flynn and his lawyers can rest easy, though, there’s something else to consider. The analysis above assumes that courts would actually apply traditional First Amendment standards to Flynn’s communications. But that’s not necessarily the case.
Under modern free speech doctrine, the scope of a U.S. citizen’s right to communicate with foreign persons, powers, and audiences is not fully settled. Throughout American history, Congress and the Executive Branch have acted as if the First Amendment does not fully apply to communications directed to foreign nationals or foreign audiences. Thus, the U.S. government has imposed and enforced a variety of content-based limits on the import and export of films, artwork, propaganda, and other materials, excluded aliens on ideological grounds, and restricted citizens’ travel to foreign nations. The Logan Act belongs to this family of speech restrictions, which has deep roots in fears about foreign influence of U.S. citizens and institutions. The laws are suggestive of a provincial concept of the First Amendment – it ceases to apply, or at least fades considerably, at the water’s edge.
Few Supreme Court cases have considered speech, press, or associational rights that involve foreign aliens or foreign audiences. Although the Court has assumed the First Amendment applies in some non-domestic contexts, it has tended to apply a very deferential form of review in such cases. The Court has never squarely addressed how communications directed to foreign persons or powers jibe with traditional First Amendment principles and justifications. Absent any clear guidance, some federal courts reviewing export laws, travel restrictions, and regulations of Internet speech have expressed doubts regarding whether the First Amendment applies the same way in those contexts as it does when one domestic citizen communicates with another. Constitutional scholars have also expressed differing views on this matter, with some questioning whether speech directed solely to foreign persons or audiences is entitled to full First Amendment protection. The Logan Act applies in this murky realm of expression – to international diplomacy communications, whether made within or outside the United States, which are directed solely to foreign governments and their agents.
Holder v. Humanitarian Law Project, a case decided in 2010, illustrates how the Supreme Court applies the First Amendment differently when foreign audiences are involved. In HLP, a group of U.S. citizens wanted to communicate with members of international organizations the U.S. government had designated “foreign terrorist organizations.” Specifically, the U.S. citizens wanted to teach members of these organizations how to resolve their disputes peacefully and to provide them with instruction in principles of international law. The U.S. government threatened to prosecute the groups under a federal law that prohibits American citizens from providing “material support” to terrorists. Even though it determined that the law targeted certain communications based on their content, the Court concluded that it was narrowly tailored to serve compelling interests in national security and foreign relations. The Court added that in its view, exchanges with foreign nationals were not “all to the good”; indeed, they raised the danger of foreign influence, which the framers were particularly concerned about.
To give you a sense of just how rare HLP’s result is, it is one of only two decisions in the Court’s history where a majority of justices has upheld a content-based law under the First Amendment. The decision was a significant departure in another respect as well. The First Amendment’s “incitement” doctrine prohibits government from restricting speech that advocates unlawful activity unless that advocacy is likely to lead to imminent harm. That’s a really difficult standard to meet. Even speech that spreads terrorist ideologies or generally advocates terrorist activities can find shelter under the First Amendment’s incitement standard. Although the incitement standard presumably would have applied had the speakers and groups all been domestic, in HLP the Court did not apply it to the material support law. It also allowed the federal government to criminalize association with foreign persons without any proof that the U.S. citizens intended to facilitate their criminal activities – a form of guilt-by-association that the First Amendment prohibits.
HLP, which is in many respects a modern-day provincial decision, casts some doubt on the conclusion that the Logan Act clearly violates the First Amendment. The Act regulates speech in a borderland that has not been clearly defined. At the very least, HLP suggests that we should not assume U.S. courts will apply ordinary First Amendment standards to speech and association involving foreign governments and foreign affairs.
But they certainly should. In HLP, the Court missed an important opportunity to explain why communicating and engaging with foreign actors and audiences are central concerns of a twenty-first century First Amendment.
The First Amendment’s marketplace of ideas has never stopped at the water’s edge. Speech directed to foreign audiences, associations that cross international borders, and information-gathering that occurs beyond U.S borders are as important to American self-governance as purely domestic speech, local associations, and in-country newsgathering. The provincial First Amendment is a relic that does not suit the world we occupy, which features cheap communication across borders, greater commingling between citizens and foreign nationals, and forms of virtual association that were unfathomable when the First Amendment was ratified.
The Flynn case would be an odd one in which to finally jettison the provincial First Amendment. Think about it: An official associated with a nationalist administration would directly benefit from a more globalist or cosmopolitan interpretation of the First Amendment. That might be a salutary lesson for a young administration led by a president who views foreigners and foreign influences with suspicion, and who as a candidate suggested that the U.S. should “shut down” parts of the Internet. More to the point, it would be exactly the right result. The First Amendment ought to be interpreted to encourage citizen engagement with international affairs, not to permit government to turn such activity into a felony offense.
